Understanding Your Consent Under the TCPA and TSR
Legal Online Directory operates as a lead generation and attorney marketplace. When you submit your information through our platform to find legal representation or professional services, you are initiating a request for contact. This document outlines the legal framework and specific permissions you grant us and our partners pursuant to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, the Telemarketing Sales Rule (TSR), 16 C.F.R. Part 310, and relevant state mini-TCPA laws.

Prior Express Written Consent
Pursuant to the FCC’s regulations at 47 C.F.R. § 64.1200(a)(3) and the TSR at 16 C.F.R. § 310.4, by clicking the submission button on our lead capture forms (e.g., "Get Started," "Find My Lawyer," or "Submit"), you are providing your "prior express written consent" to be contacted.
This consent applies even if your telephone number is currently listed on a corporate, state, or the National Do Not Call Registry (15 U.S.C. § 6101). Your consent is not a condition of purchasing any property, goods, or services, but it is necessary for us to process your request for an attorney match or legal funding referral.
One-to-One Consent Rules (2024-2026 FCC Standards)
In compliance with the FCC’s "Second Report and Order" (FCC 23-107), Legal Online Directory adheres to the One-to-One Consent requirement. This means we do not obtain a single consent to be contacted by an undefined list of hundreds of "marketing partners."
- Selective Matching: Our platform uses a logic-based intake system to identify the specific attorney, law firm, or legal service provider best suited for your case type and jurisdiction.
- Clear Disclosure: Before you submit your data, the platform identifies the specific entity or entities that will receive your information.
- Direct Authorization: By submitting, you authorize only Legal Online Directory and the specifically identified partner(s) to contact you regarding your inquiry.
Methods of Contact and Technology Used
By providing your consent, you agree that Legal Online Directory and our matched partners may reach out to you using the following methods:
- Autodialed Calls: Calls made using an "automated telephone dialing system" (ATDS) as defined by 47 U.S.C. § 227(a)(1).
- Prerecorded Messages: The use of artificial or prerecorded voices to deliver messages regarding your inquiry.
- Text Messaging (SMS/MMS): Automated messages sent to your mobile device. Standard message and data rates may apply.
- Email: Communications sent pursuant to the CAN-SPAM Act, 15 U.S.C. §§ 7701-7713.
State-Specific Telemarketing Regulations ("Mini-TCPAs")
Several states have enacted legislation that is more restrictive than the federal TCPA. Legal Online Directory and its partners comply with these variations as follows:

Legal Online Directory’s technology stack accounts for these state-specific time-of-day restrictions, ensuring no contact is initiated outside of legally permissible hours based on the area code or zip code provided.
Revocation of Consent and "Opt-Out" Rights
You have the right to revoke your consent at any time. Under the FCC’s 2024 Revocation of Consent Order and 47 C.F.R. § 64.1200, we must provide a "reasonable" means for you to opt out of future communications.
- For Text Messages: Reply "STOP" to any message you receive. Our system is configured to process this keyword immediately (or within the 10-day safe harbor) to cease all further automated SMS traffic to that number.
- For Phone Calls: During any live call, you may request to be placed on our internal Do Not Call list.
- Verification: You may receive one final text message confirming that you have been unsubscribed.
- Global Privacy Control (GPC): If you reside in a state with comprehensive privacy laws (such as California, Virginia, or Colorado), we recognize GPC signals as a valid request to opt-out of the "sale" or "sharing" of your data for telemarketing purposes under the CCPA/CPRA (Cal. Civ. Code § 1798.120) and similar state statutes.
Data Retention and Lead Documentation
To protect both our users and Legal Online Directory, we maintain evidence of your consent as required by the TSR and state evidence rules. We use third-party "lead integrity" tools (like Jornaya or TrustedForm) to document that you were the individual who interacted with our site. This documentation captures:
- The date and time of consent.
- The IP address and browser information.
- A visual record (screenshot or video replay) of the disclosure appearing at the time of submission.
- The specific language you agreed to.
This data is retained in accordance with our Privacy Policy and the applicable statute of limitations for TCPA claims (typically four years under 28 U.S.C. § 1658(a)).
Attorney Referral and Fee-Sharing Disclosures
Where your lead is transferred to an attorney for a potential case exchange or referral, additional professional rules applies. We comply with ABA Model Rules of Professional Conduct 7.1 through 7.3 regarding attorney advertising.
If Legal Online Directory receives a referral fee or a percentage of a legal settlement, this will be disclosed to you by the participating attorney in a separate Retainer Agreement, as required by ABA Model Rule 1.5(e) and corresponding state bar rules (e.g., California Rule of Professional Conduct 1.5.1). Some states, such as New York and Texas, have specific requirements for how non-lawyer entities may interact with law firms; we do not engage in the Unauthorized Practice of Law (UPL) and do not interfere with the attorney’s independent professional judgment.
Accuracy of Information
Under the FTC Act, 15 U.S.C. § 45 (Section 5), we are committed to preventing "unfair or deceptive acts or practices." When you provide your phone number, you represent that you are the subscriber or the customary user of the number provided. Providing a number that does not belong to you is a violation of our Terms of Service and may result in liability under the TCPA for "spoofing" or fraudulent lead generation.
